In short, for anyone booking a consultation:
- You buy the consultation from TaxAtivo. It is given by a certified accountant, registered with the Portuguese Order of Certified Accountants (Ordem dos Contabilistas Certificados), whom you choose before you pay.
- It is a clarification consultation on accounting and tax, based on the facts you tell us. It does not include representing you before the Tax Authority, Social Security or the courts.
- You pay when you book, and the invoice-receipt is issued on the day of payment.
- Cancellations, no-shows, refunds and withdrawal within 14 days are covered in the cancellation, no-show and refund policy.
- We are responsible to you for the consultation, including for what the accountant does, and nothing in these terms takes away the rights the law gives you.

Part 1 · For anyone booking a consultation
1. What you buy
- The contract for the consultation is between you and TaxAtivo. TaxAtivo sells you the consultation, takes the payment and issues the invoice.
- The consultation is given by an independent certified accountant, who provides the service to TaxAtivo. Before you pay, you see their name, their registration number with the Order of Certified Accountants, the service, the length, the channel, the time and the price.
- For now, consultations are by video or by call, at the booked time, in a TaxAtivo room that you open in your browser. The link to the room appears on the consultation page.
- The accountant may offer you a free follow-up from a paid consultation, of the same length or shorter. The offer says until when you can book it.
2. What the consultation includes and what it does not
It includes clarifying your accounting and tax questions, such as income tax (IRS), VAT, self-employment receipts (recibos verdes), Social Security and starting or changing a business activity, based on the facts you give and the documents you show during the consultation.
It does not include:
- representing you before the Tax Authority, Social Security or the courts;
- complaints, appeals and challenges;
- signing or filing returns for you;
- organised accounting or an ongoing accounting contract;
- reviewing documents you did not ask to be reviewed in the consultation;
- matters for other professions, such as inheritances, leases, employment contracts or disputes. If your question turns into a dispute, you need a lawyer;
- guaranteeing an outcome with the Tax Authority or Social Security.
The accountant gives you the best answer they can based on what you tell them, but does not guarantee an outcome.
The consultation does not suspend or extend any deadline of the Tax Authority or Social Security. If a deadline of yours ends today, we cannot guarantee that an accountant will be available in time.
3. Your account
- You sign in with your Google account or with a code we send you by email. You are responsible for keeping access to your email secure.
- The conditions for having an account, such as being 18 or over, are in the code of conduct.
4. Price, payment and invoice
- Each accountant sets the price of their services. Before you pay, you see the total price, VAT included.
- You pay when you book, with one of the methods shown at checkout, and the button tells you how much you pay. The time is held while you pay (with Multibanco, until the reference expires), and the consultation is only confirmed when the payment arrives.
- If you have credits, they pay for the consultation, or part of it, and the rest is paid with the method you choose.
- The invoice-receipt is issued on the day of payment: with your name and tax number, if you give it, or to a final consumer, if you do not. A refund always has a credit note.
- Payments are processed by Stripe. The payment details you enter go directly to Stripe and never pass through us.
5. Cancellations, no-shows, refunds and withdrawal
What happens if you cancel, if you do not show up, if the accountant cancels or does not show up, or if the connection fails, how you ask for a refund and how you withdraw from the contract within 14 days, with the form, is set out in the cancellation, no-show and refund policy. It is part of these terms.
6. The consultation room
- You need an up-to-date browser, a stable internet connection and, for a video consultation, a camera and a microphone. Your browser only asks for permission on the room page.
- TaxAtivo does not record consultations.
- We record the time at which each of you first enters the room. It is used to know whether the consultation started and whether someone did not show up.
7. Code of conduct
The code of conduct applies to you and to the accountant and is part of these terms.
8. Confidentiality and personal data
- The accountant is bound by professional secrecy about what you tell them, also after the consultation. The law makes exceptions, such as the reporting duties for the prevention of money laundering.
- How we process your data is set out in the privacy policy, and cookies in the cookie policy.
9. Liability
- TaxAtivo is responsible to you for the consultation, including for what the accountant does or fails to do in it, under the law.
- To be approved, the accountant shows us a valid professional liability insurance policy.
- Nothing in these terms excludes or limits the rights the law gives you as a consumer.
10. Complaints and disputes
- If something went wrong, write to us at info@taxativo.pt. We reply as quickly as we can.
- You also have the electronic Complaints Book (Livro de Reclamações), with the link in the website footer.
- About the professional conduct of an accountant, you can file a complaint with the Order of Certified Accountants.
- If we cannot reach an agreement, you can turn to a consumer dispute arbitration centre. In a dispute of up to €5,000, if you choose arbitration, the law requires us to accept it: we are bound by the competent arbitration centre for your area and, where there is none, by CNIACC, the National Centre for Consumer Dispute Information and Arbitration (www.cniacc.pt). The list of centres is on the Consumer Portal (www.consumidor.gov.pt).
- Portuguese law applies. Disputes go to the courts with jurisdiction under the law.
11. Changes to these terms
We may change these terms, for example when the law changes or when we add a service. The new version only applies to consultations you book after we publish it. A consultation already booked follows the version you accepted, which is kept with its date and version.
Part 2 · For the certified accountant
12. The relationship
- You provide TaxAtivo with a consultation service, which TaxAtivo sells to the client. You do this as an independent professional, with technical autonomy. There is no employment contract.
- You set your hours, your services and your prices, and you only receive bookings in the hours you open. You can cancel a booking up to the booked time, with a message to the client. There is no exclusivity, no minimum hours and no minimum number of consultations.
- How you give the consultation is up to you. The rules you must follow are those of the law, of the Statute of the Order of Certified Accountants, of the Code of Ethics and of the code of conduct.
- These terms, accepted in the portal with the date and version, are the written contract between you and TaxAtivo.
13. To join
- Active registration with the Order of Certified Accountants. We check it in the Order's public register before approving you, and we may check it again.
- Insurance. To approve you, your professional liability insurance policy must be valid and cover consultations for people who are not your accounting clients, including those given through platforms. We remind you by email 30 and 7 days before it ends. If it lapses, the code of conduct applies. We ask you to keep the policy, or equivalent cover, for 24 months after your last consultation on TaxAtivo.
- Your details. Tax number, date of birth, address, IBAN, VAT regime, tax region, withholding exemption, the declaration of registration with the Order and the insurance policy. They are needed to pay you and for TaxAtivo's legal obligations, including the annual report to the Tax Authority of payments made through the platform (DAC7).
- Approval is made by a person at TaxAtivo, never by an automated system.
14. Prices, commission and payments
- The price of each service is yours. TaxAtivo may set a minimum selling price per service. A service below the minimum in force does not appear in the list, and the portal shows you which ones are affected. If the minimum goes up, we tell you by email 15 days before it applies: if you update your price by then, the service stays in the list.
- TaxAtivo keeps a commission on each paid consultation.
- Your earnings for each month are grouped in a batch. You issue an invoice for the batch to TaxAtivo and are paid by bank transfer to the IBAN you gave us, within 5 working days after we validate the invoice. Income tax withholding applies when the law requires it.
- What you are owed when a client cancels or does not show up is set out in the cancellation, no-show and refund policy.
- A free follow-up does not generate earnings.
15. Complaints and recourse
- Towards the client, TaxAtivo is responsible. If TaxAtivo has to pay the client because of an error or omission of yours in the consultation, through your fault, you compensate TaxAtivo for that amount and for the reasonable costs of the defence.
- If you receive a complaint about a TaxAtivo consultation, you tell us, and your insurer, within 5 working days. You do not admit fault without talking to us, and you give us the information needed, within professional secrecy.
- TaxAtivo may deduct from later batches what you owe it under this clause, with prior notice and an itemised account.
- Without fault on your part, for example a platform failure or client fraud, TaxAtivo bears the cost.
16. Confidentiality and client data
Professional secrecy and the rules on client data are in the code of conduct and continue to apply after you leave TaxAtivo.
17. The list of accountants
The order of the public list changes every day, at random. It does not depend on ratings, payments or the number of consultations.
18. Suspension and end of the contract
- You can leave whenever you want: write to us at info@taxativo.pt. Consultations already booked are carried out or cancelled as set out in the cancellation policy.
- TaxAtivo only suspends your bookings or ends the contract for the reasons and with the notice periods in the code of conduct, after hearing you (except in urgent cases), with a decision by a person and the reasons in writing, by email. You can ask for the decision to be reviewed.
19. Changes to these terms
We tell you by email about any change, 15 days in advance. If you do not agree, you can leave before it applies, at no cost.
20. Applicable law
Portuguese law applies. Disputes go to the courts with jurisdiction under the law.
